Everything you see on this website is protected by copyright, and all rights are reserved.
This includes the patterns and charts available on this website, or from the girl from auntie, whether they're free or not. It also includes my knitted creations.
The free knitting patterns on this site are for your own personal, non-commercial use. Any further use requires my express permission.
You may not distribute (for free, or for compensation) copies of the free patterns in printed, electronic, or any other format.
You may not knit up items from the free patterns on this site for sale without my express permission. Knitting on commission is fine; by commission, I mean that there must be a pre-existing agreement between the knitter and the recipient that the knitter will make the item specifically for that recipient in exchange for money, gratitude, or whatever favours happen to be the subject of negotiation. Knitting up an item and then putting it up for sale at a fair, for example, is not knitting on commission. See the difference?
If you purchase a pattern, the terms and conditions are below.
To clarify some hotlinking or image "borrowing" issues: at the present time, I do not object to individuals hotlinking to or uploading to their own server images of the patterns for sale or the patterns offered for free on this website for non-commercial purposes--for example, if you're a blogger talking about knitting Rogue, and you want to insert an image of the finished product on your webpage, go ahead. This permission for hotlinking depends on the effect on my bandwidth consumption: if it starts costing me too much, then I'll disable hotlinking or request that you host the image yourself. However, if you hotlink or upload a copy of the image to your own server, please include a link back to this website so people know where it came from.
If you want to use an image for commercial purposes, then you need to get my permission first, and you must include a link back to this website.
Hotlinking or other borrowing of other graphics, whether you're hosting it yourself or not, is never allowed without prior express permission. If I catch you hotlinking something you shouldn't, I'll swap the image for something you will find embarrassing. I've done it, you know.
And, by the way, in case you didn't realize it: all the stuff you see on this page is protected by copyright, too. Yes, that's right, all this legal verbiage doesn't just provide or enhance legal protection, it's entitled to legal protection, too.
Your privacy
This privacy statement, which applies to Canada, describes how the girl from auntie (occasionally referred to as "she" or "her" or "us" for the sake of narrative flow) collects, uses and discloses personal information of individuals with whom the girl from auntie deals, in the course of commercial activities, both online and offline ("you" or "your"). the girl from auntie will take reasonable steps to protect your privacy in accordance with this privacy statement and applicable law.
Ordering and purchasing from the girl from auntie
If you wish to purchase a product from the girl from auntie, you may either (1) use the PayPal and PayLoadz services, or (2) place your order directly via e-mail to the girl from auntie.
PayPal and PayLoadz
When you click the "add to cart" button, you will be transferred to the PayPal website. In order to use the PayPal service, you must be registered with PayPal. During the registration process, PayPal will collect (or if you are already registered, PayPal will have already collected) certain personal information about you, including your name, address, e-mail, bank account and/or credit card information. Please note that PayPal handles your personal information in accordance with its own privacy policy, a copy of which is available at http://www.paypal.com.
When you confirm your purchase, PayPal provides the girl from auntie with the following information: your name, e-mail address, mailing address, and the particulars of your order and/or purchase ("purchase information"). the girl from auntie never receives your bank account or credit card information from PayPal.
In order to provide electronic document download delivery, Paypal transfers, on behalf of the girl from auntie, your purchase information to Payloadz.com. Payloadz.com has its own privacy policy, a copy of which is available at http://www.payloadz.com/privacy.asp. To the best of the girl from auntie's information, Payloadz.com does not receive your bank account or credit card information either.
E-mail purchases
If you wish to purchase a product from the girl from auntie, but do not wish to provide your personal information to PayPal and PayLoadz.com in the manner described above, you may place an order via e-mail to the girl from auntie and specifically request e-mail delivery of the product. You will receive instructions from the girl from auntie for making payment via regular mail (post) using an offline payment method, such as an international or Canadian money order. The delivery of your product or service will still take place electronically via Payloadz.com, but the delivery will be made upon the instruction of the girl from auntie and not via PayPal.
How the girl from auntie uses your purchase information
the girl from auntie uses the purchase information that you provide for the purposes for which it was provided, namely to establish your identity, administer and process your requests for products or services, and respond to your inquiries about the girl from auntie's products or services.
the girl from auntie may also use your purchase information to send you e-mail updates or corrections to products you have already purchased. If you prefer not to receive such communications from the girl from auntie, you may opt out of such uses by e-mailing rights@girlfromauntie.com.
Consent
By providing the girl from auntie with your personal information, you, or if you are under the age of majority in your place of residence, your parent or legal guardian, consent to the collection, use and disclosure of that information as described in this privacy statement as amended from time to time or as described at or before the time of collection, use or disclosure, as the case may be.
If you do not want your personal information to be collected, used or disclosed in this manner, then please either (1) do not submit your personal information to us, and/or (2) exercise the opt-out procedures described in this privacy statement, or as may be offered at the time of collection.
If you have submitted personal information to the girl from auntie and wish to withdraw your consent to its retention, use or disclosure, please send an e-mail to rights@girlfromauntie.com. You may withdraw your consent, subject to legal or contractual restrictions and reasonable notice. If you withdraw your consent, the girl from auntie may not be able to provide some products or services to you.
Where permitted or required by law, the girl from auntie may collect, use or disclose your personal information without your consent, for example to collect a debt.
Retention of personal information and security safeguards
the girl from auntie will destroy, erase or render anonymous personal information no longer required for the stated purposes or for a legal or legitimate business requirement.
the girl from auntie takes precautions to protect your personal information against unauthorized access, disclosure, inappropriate alternation, and misuse. Access to your personal information is restricted to those persons whose job responsibilities require them to have access. The precautions taken to protect your personal information include physical, organizational, and technological measures. However, given that electronically transmitted data is not 100% secure, the girl from auntie makes no warranties as to the security of any information that you submit to her electronically, which you do at your own risk.
Cookie technology and website aggregate data
the girl from auntie does not utilize cookies on this website to carry on business. (If any part of the website does use cookies in order to facilitate operation of any website feature, this fact will be documented on the website.) However, please note that PayPal utilizes cookie technology to store some information on your computer in order to administer the PayPal shopping cart. This information is required to administer and process purchases through PayPal, and is governed by your user agreement with PayPal. Most browsers are initially set up to accept cookies, but you can set your browser to alert you every time a cookie is offered, letting you decide whether or not to accept it. You also have the option to set your browser to refuse cookies. If you choose to refuse cookies, you will not be able to purchase products or services from this website using PayPal.
the girl from auntie logs IP addresses, but not the e-mail addresses, of visitors. This information is aggregated and logged, and used to measure statistical information about usage of the website, including but not limited to the total number of visits, average time spent on the site, and pages viewed, both in real-time, and within a certain historical time frame. the girl from auntie may use this aggregated information to measure the use of the website and to improve the content and usage of the website.
Other websites
This website contains links to other websites owned and operated by third parties, including PayPal. The third parties who operate these sites may treat the collection, use and disclosure of personal information differently than the girl from auntie does. This could be the case even for those websites which carry the girl from auntie's trade-marks, trade names, or logos or which are framed by this website. the girl from auntie therefore encourages you to review the privacy policies of these websites before disclosing your information to any third party. the girl from auntie is not responsible for the data collection, use and disclosure practices of companies or organizations to which this website may provide links.
How to access or correct your personal information
the girl from auntie will establish and maintain a file of the personal information that you provide to her, for the purposes described in this privacy statement as amended from time to time or as described at or before the time of collection, use or disclosure, as the case may be. Only the girl from auntie and her agents and mandataries who need to access your file in the course of their duties will have access to your file.
If you wish to request access to, or correction of, your personal information, please write to the girl from auntie at rights@girlfromauntie.com. Some information may not be accessed in certain circumstances, for example if it contains personal information of other persons or for legal reasons.
Changes to this privacy statement
This privacy statement was last updated on January 27, 2006 and the girl from auntie may change this privacy statement from time to time. If the girl from auntie makes a material change, this privacy statement will be updated accordingly and the revised version will be posted on the website in a timely manner. the girl from auntie recommends that you review this privacy statement periodically so that you are aware of any changes.

Licence agreement for patterns sold at or by the girl from auntie website
This agreement was changed and is effective February 15, 2008
This agreement does not apply to patterns available for free from the girl from auntie. However, patterns available for free from this site are protected by copyright law, just as much as the patterns available to purchase are protected. Print editions of the girl from auntie patterns are not covered by this licence agreement. You do not get the benefits of this licence agreement if you purchased a print edition, because that purchase was made from a retailer and not from the girl from auntie. Print editions are protected by copyright law and the permissions listed in section D are not granted to you. You must contact the girl from auntie to negotiate a licence if you wish to produce garments or items under commission or for sale.
By purchasing, downloading, installing, copying, printing, or otherwise accessing a pattern from the girl from auntie, you are agreeing to the terms below. If you do not agree with the terms, then either (a) don't buy the pattern; or (b) if you have already made the purchase, do not download the pattern (or delete it immediately) and e-mail to request a refund.
A. What do you get when you make a purchase?
1. You get a copy of the pattern in PDF format, which you can use in accordance with this licence agreement. This licence agreement allows you to do what you'd normally be legally allowed to do with a printed pattern you bought from a store, plus a little more.
2. Most of what you get under this licence agreement is attached to the pattern purchase. One particular entitlement, however, is attached to the original purchaser. Rights that follow the licence (and will follow the pattern if it is sold or given away in accordance with this agreement) include the right to make personal working copies and backup copies. However, the entitlement to receive e-mail support, described in section F, belongs to the original purchaser only.
B. Copyright
3. You agree that the pattern, whether in electronic, print, or any other format, the original garment or item, the original design, and the underlying artwork, are protected by copyright law and international copyright treaties, and furthermore that the copyright is owned by the girl from auntie. You also agree that you will not distribute, upload, or communicate the pattern in whole or in part, in any form whatsoever, except in accordance with this licence agreement.
C. What can you do under this licence agreement?
4. You can download a first copy of the pattern in PDF format (which may be compressed to speed up download time) from the girl from auntie.
5. You can knit as many garments or items as you like from the pattern, either for yourself or as gifts for others. If you want to sell the garments or items, see the additional terms in section D.
6. You can knit as many garments or items as you like for charity, provided that they are intended for direct charitable acts: as an example, if you are knitting hats, then the recipients of the hats must be the recipients of the charitable works. If the garments or items are intended to raise money for charity, see section D.
7. You can make a backup copy of the PDF file on any computer storage medium (e.g. hard drive, CD-R/RW, DVD-R/RW, memory key, or any other storage medium), to be used only if your first copy is erased, corrupted, or otherwise rendered unusable, and which you may keep as long as you have not given away or sold the pattern. For clarity, under this agreement you are liable for all damages and other financial remedies, including but not restricted to an accounting of profits, legal fees, punitive damages and/or an injunction in the event that any authorized copy of the pattern in your possession is distributed to, or accessible by, others without permission from the girl from auntie, whether this distribution or making accessible is committed by you deliberately or inadvertently, or by a third-party service provider providing services to you, deliberately or inadvertently. If you are using a third-party service provider to store a copy of your pattern, you will still be held liable for errors or omissions committed by your third-party service provider in the provision of their services, and it will be up to you to recover from that third-party service provider.
8. You can print out as many working copies of the pattern as you personally need, as long as they remain in your possession and as long as you have not given away or sold the pattern.
9. You can give the electronic pattern away once you're done with it to one person only, as long as you do not retain any copies for yourself, whether they are working copies or backup copies, in paper or electronic form, whether stored locally or remotely from you. Any such copies must be deleted or destroyed when the electronic pattern leaves your possession. If you give the pattern away, then you have assigned your rights under this licence agreement to the recipient, and the recipient must agree to be bound by the terms of this licence agreement: see section E.
10. You can sell the pattern once you've done with it to one person only, as long as you do not retain any copies for yourself, whether they are working copies or backup copies, in paper or electronic form, whether stored locally or remotely from you. Any such copies must be deleted or destroyed when the electronic pattern leaves your possession. If you sell the pattern, then you have assigned your rights under this licence agreement to the buyer, and the buyer must agree to be bound by the terms of this licence agreement, and this agreement must be in writing: see section E.
11. You can lend the pattern only by giving it away, as described in paragraph 9. That means your backup copies or working copies, whether stored locally or remotely from you must either be deleted or destroyed when the pattern is lent out. In fact, the only difference between giving your pattern away, as in paragraph 9, and lending the pattern is that you're trusting you'll get the pattern back. Just as in paragraph 9, the person borrowing your pattern must agree to be bound by this licence agreement as well: see section E.
D. How many garments or items can you sell or make for commission, or use for charitable fundraising under this licence agreement?
12. You personally may make and sell items using the pattern, provided these items are made by you, the licensee, personally, and not by others, and are sold by you, the licensee, personally, to the end user (customer) and not to a retailer, distributor, or other reseller and provided that you provide acknowledgment to the purchaser, at least at the point of sale, that (a) the item was made from a pattern available from girlfromauntie.com and under the terms of its angel policy, and (b) indicating the identity of the maker of the item. You agree that you are liable for damages, an accounting of profits, legal fees, and/or may be subject to an injunction for each sale and offer for sale in violation of these terms. You must also e-mail me to tell me what you're doing, because I'm quite curious.
13. For charitable fundraising, the girl from auntie reserves the right to revoke the permissions granted in this licence agreement in the event that the charitable object of the fundraising effort is determined to be objectionable.
E. And what happens when I sell the pattern or give it away?
14. The licence attached to each pattern is transferable and assignable by you, as mentioned in paragraph 9. This means that you can sell the pattern, or give it away, to one person as long as you do not retain any copies for yourself, whether they are working copies or backup copies, in paper or electronic form. Any such copies must be deleted or destroyed when the electronic pattern leaves your possession.
15. When you sell the pattern or give it away, it must be intact in its original electronic format, which includes the notice on the last page that the pattern is protected by copyright and distributed under the terms of this agreement.
16. The licence granted in paragraph 12, above, is attached to the first licensee. It is not automatically renewed when the pattern changes hands. When you transfer your rights in the pattern, the licence granted in paragraph 12 is exhausted.
17. The recipient or the buyer of the pattern agrees to be bound by the terms of this licence agreement; however, the recipient or the buyer will not be entitled to support for the pattern, as described in section F. Note that if you are purchasing the licence as a gift for someone else, we can carry out the transaction in a manner that entitles the gift recipient to support. E-mail for details before making a purchase.
18. You may not, under any circumstances, give or sell a copy of the pattern to more than one person. You may not purchase multiple licences for resale.
F. Personal support
19. I will make my best efforts to provide reasonable support for the purchaser of the pattern by e-mail only. See the support page for a discussion of "reasonable support". Support will only be provided to the e-mail address that is used to effect the purchase of the pattern. Do not expect to receive support via a different e-mail address unless you can convince me that you're the same person who bought the pattern.
20. This support is not available to a subsequent assignee or transferee of the pattern licence. That means that if you sell or give away the pattern, the person who receives or buys the pattern from you will not receive this support.
21. the girl from auntie is not responsible for your skill level. If you do not possess the requisite abilities to knit a pattern, it is your responsibility to brush up your skills. The best I can do is point you towards a book or website that provides information about the techniques used, and no, I'm not going to lend you any of my books.
G. Other things that aren't my fault
22. the girl from auntie is not liable for your computer hardware. These patterns are graphics intensive and may take some time to render to your screen or spool to your printer. If your computer can't handle the file size, I will make my best efforts to supply you with usable substitute electronic files, but I will not provide a print copy. Any replacement or substitute electronic files are provided pursuant to this licence agreement, and the terms of this agreement apply to those files.
23. the girl from auntie is not liable for any software installed on your computer. It is your responsibility to make sure that any software required for displaying and printing the pattern (printer drivers, PDF readers, decompression programs, etc.) is installed on your system and that proper licences have been obtained for this software. For further information, you should contact the manufacturer of that software.
H. And a few other terms
24. By purchasing a pattern, in the event of a dispute you agree to attorn to the jurisdiction of the Ontario Superior Court of Justice, Toronto Region, and the Federal Court of Canada, and agree that any disputes shall be resolved in accordance with Canadian law.
25. This licence agreement was last revised on February 15, 2008. The terms of the licence agreement published on the girl from auntie website may be unilaterally revised from time to time by the girl from auntie, and the revised version shall be binding on you. The terms of the licence agreement may also be revised by negotiation between you, the purchaser, and the girl from auntie. In that case, the amended licence agreement, as agreed to by the two of us, shall be the governing agreement between us.
26. Headings in this licence agreement do not form part of this licence agreement.
